كفاءة إدارة الأموال والرقابة عليها في الهيئة العامة للولاية على أموال القاصرين ومن في حكمهم: دراسة تحليلية

لا شك أن الولاية على أموال الأيتام والقاصرين ومن في حكمهم من الأمور ذات الأهمية البالغة والتي أولتها المملكة العربية السعودية اهتماماً بالغاً من جميع النواحي، وقد أنشأت في سبيل ذلك لهيئة العامة للولاية على أموال القاصرين ومن في حكمهم” على ضوء ذلك قامت الدراسة على دراسة للائحة التنفيذية لهذه الهيئة ومعرفة مدى أمكانية قيامها بالأهداف التي أنشأت من أجلها. حيث كانت أهداف البحت، هي التعرف على طرق إدارة هذه الأموال. وتقييم إدارة تلك الأموال ومدى قدرتها على تحقيق قصد الشارع منها، والتي تحكم تفاصيل وآليات عمل الهيئة. وكذلك التعرف على دور الأجهزة الرقابية في الحفاظ على الأموال التي تقع ضمن اختصاصات الهيئة العامة للولاية. استخدم الباحثان منهج البحث التحليلي والذي كان مقتصراً على دراسة الإطار النظري للتعامل مع أموال الأيتام والقاصرين ومن في حكمهم في ضوء اللائحة التنفيذية للهيئة، وكانت دراسة معمقة مسترشدة بعدد من المبادئ التي تم استخلاصها من الإطار الشرعي الذي يحكم التعامل مع أمول الأيتام والقاصرين ومن في حكمهم، كذلك المبادئ الرقابية التي تحكم ضمان وسلامة حفظ تلك الأموال وتنميتها. وتوصلت الدراسة إلى أن الإجابة عن تساؤلات البحث والتي كانت متمثلة في هل هناك إدارة جيدة للأموال التي تقع تحت ولاية الهيئة تكفل الحفاظ عليها؟ وكذلك ما هو دور أجهزة الرقابة المالية التي نص عليها نظام الهيئة في الحفاظ على هذه الأموال وضمان سلامتها، فبالإجابة عن التساؤل الأول ترى الدراسة أن الهيئة وبالرغم من المجهود الذي تقوم به مشكورة في عملها إلا أنه يشوبها بعض النقص والمتمثل في بعض الملاحظات على اللائحة التنفيذية والتي من أهمها أن اللائحة لم تتطرق لمرحلة انتهاء الولاية والتي ظهرت كإحدى المراحل الرئيسية في الإطار الشرعي والرقابي. وفي اجابة لتساؤل الثاني لم توضح الهيئة لا من قريب ولا من بعيد آليات الرقابة على تلك الأموال. كما قدمت الدراسة عددًا من التوصيات ومن أبرزها التوصية بإضافة مادة في اللائحة التنفيذية تبين آلية رد الأموال إلى المستفيدين منها في حال انتهاء الولاية عليهم. الكلمات المفتاحية: إدارة الأموال، الرقابة المالية، هيئة الولاية.

There is no doubt that the guardianship of the funds of orphans, minors and the like is of the utmost importance, which the Kingdom of Saudi Arabia has given keen attention in all respects and has established for this purpose the State General Authority on the funds of minors and the like. Also, the supervisory principles governing the guarantee and safe keeping and development of such funds. The study concluded that the answer to the research questions was that there is a good management of funds that fall under the mandate of the Commission to ensure their preservation? In addition, what is the role of the financial control bodies stipulated in the Authority’s system in preserving these funds and ensuring their safety? In response to the first question, the study finds that the Authority, despite the efforts it is doing, is skeptical in its work, but may be tainted by some shortcomings, represented by some observations on the executive bylaw. Most importantly, the list did not address the termination of the mandate, which emerged as one of the main stages in the legal framework and control. In response to the second question, the Commission did not clarify the mechanisms of control over those funds. The study came up with a number of recommendations, most notably the addition of an article in the executive regulations stating the mechanism of refunding the beneficiaries in case of termination.
