مدى الحماية القانونية من العنف الأسري في العراق والدول العربية (دراسة قانونية)

العنف الأسري هو الاستخدام الفعلي للقوة أو التهديد بإلحاق الأذى والضرر بالأشخاص والاتلاف للممتلكات فهو فعل يبالغ في السلوك العدواني أو العدائي يترتب عليه ارسال مؤثرات مقلقة أو مدمرة تحدث أذى نفسي أو مادي في البشر وقد عرفت لجنه امريكية متخصصة بدراسة قضايا العنف الأسري بانه سلوك أفراد ضد أفراد اخرين يهددهم أو يوقع بينهم ضررا أو يحاول ايقاع هذا الضرر. لقد تناول المفكرون الاسلاميون موضوع العنف الأسري منذ مطلع مهد الاسلام حيث جاﺀ ذكره في أحد الأحاديث الشريفة حيث ورد في أحد الاحاديث (إن الله رفيق يحب الرفق ويعطي على الرفق ما لا يعطي على العنف) وكذلك قول الرسول الكريم (صلى الله عليه وسلم): (لم أبعث طعانا ولا لعانا) وأيضا قوله (صلى الله عليه وسلم): (من روع مسلما روعه الله يوم القيامة) ونهى الرسول أن يشير المسلم لأخيه المسلم بأقبح الصفات. يرتبط العنف الأسري بروابط اجتماعية في الوسط الذي يوجد فيه إلا أن مظاهره واشكاله تطورت وتنوعت بأنواع عديدة منها 1- العنف ضد المرأة 2- العنف الأسري ضد الطفل 3- العنف الأسري ضد المسننين. أن العنف كما حددته القوانين والدساتير عند تأسيس الدولة الحديثة حيث اخذ صيغته الرسمية منذ مطلع القرن التاسع عشر حيث تم تعريفه باعتباره ظاهرة ترمي إلى احداث خلل في البنية التي تنظم مجتمع قائم مما ينتج عنه تهديد نظام الحقوق والواجبات. وعليه سنتناول هذا الموضوع في ثلاث مباحث الأول عن مفهوم العنف الأسري والثاني عن أسباب وأنواع العنف الأسري والثالث عن قوانين الحماية من العنف الأسري في الدول العربية. الكلمات المفتاحية: العنف الأسري، الاستخدام الفعلي للقوة، إلحاق الأذى، الضرر.

Family violence is the actual use of force or threat to harm, harm people, and damage property. Family violence is linked to social ties in the center in which there are, however, its manifestations and forms have evolved and varied in many ways, including: 1. Violence against women 2. Domestic violence against children 3. Domestic violence against the elderly. Violence, as defined by laws and constitutions at the founding of the modern state, has taken its official form since the beginning of the 19th century. It has been defined as a phenomenon designed to disrupt the structure of an existing society, thus threatening the system of rights and duties. Therefore, we will address this issue in three sections I on the concept of domestic violence and the second on the causes and types of domestic violence and the third on the laws of protection against domestic violence in the Arab countries.
